Kids sue McDonald's
Read this in today's newspaper
I personally laughed when I first heard this mentioned a few months back as they don't exactly hold a gun to your head and make you eat their food and personally feel it's the individual's choice whether or not they choose to eat what they eat but again they don't exactly promote healthy eating.
what do you think?
Should they be allowed to sue? we are always being told about having healthy diets and that we should be looking after ourselves. Should these kids get any money from Maccy D's for not having warned people that eating these meals everyday could cause ill health or weight gain?

FAST food giants McDonald's appeared in a New York court yesterday to deny creating a nation of fat children.
A group of eight overweight youngsters are suing the company, claiming they didn't know a burger and chips diet would make them fat.
They include 5ft 6ins Gregory Rhymes, 15, who weighs more than 28 stones and has diabetes after eating McDonald's nearly every day since he was six.
In court papers, his mother Ruth said: "I always believed McDonald's food was healthy for my son."
Lawyer Samuel Hirsch, acting on behalf of the families, said McDonald's created a national epidemic of fat kids and failed to warn consumers of possible health risks.
But McDonald's lawyer Brad Lerman told the court: "People don't go to sleep thin and wake up obese. The understanding of what hamburgers and french fries do has been with us for a long, long time." [B]

Fair enough if the kid didn't realise it, but the mother? No I don't think they should be able to sue, mind you there are always some people who have to take things to the extreme...

Even if McDonald's isn't 'healthy' (which I never believed it was), if the kid sits at home, playing computer games and never does an ounce of excercise, of course he'd be fat. If he ate salad and never did any excercise, he may not be as fat, but just as unhealthy.
Still, I'd laugh if McDonald's lost. May it's a conspiracy by Burger King to become god of the fast food industry!

It doesn't surprise me what some people ty and sue for. It'd be just typical that McDonalds will lose this as well. It's common knowledge that fast food is bad for you and if these people didn't know that they obviously haven't taken any notice of the media or even their education.

It just defies common sense that people would have no idea. and as for not having clear enough warnings on the menus, well what can I say. Just goes to show what anyone will do for a quick buck

Obviosly these people will have lost the weight that they have put on from Mac D's as they will have stopped eating fatty foods and only eat healthy food
Food is about freedom of choice sometimes I like some fruit sometimes I like some chocolate, Its my choice to decide what I eat. These people dont need cash from McD they need some education in nutrition.

Posted: 19:59 Nov 22 2002 i dunno about that my sister worked in a maccy d's when she was young and back then you could eat as much as you wanted when on lunch she gained so much weight then and has hasnt lost it since butut then again i dont think honestly she tried.

It honestly wouldn't surprise me if they were succsessful in their claims.
Over the past 3 years i've seen some silly things being awarded to equally silly people.
I remember my consumer law lecturer telling me about 2 McDonalds cases in the USa:
1. A woman successfully sued them as she got a coke and not a diet coke
2. A man/woman (cant remember which) sued because she got a cup of coffee to take away, it was in her car and she had it on her knee, it spilt and she sued saying there failed to be sufficient warning on the packaging saying that it was hot. (note on the cups now there is a 'caution notice)
I mean come on....its coffee made with hot water!! What the hell did she think would be in it...if it was cold she would have complained!

Should they be able to sue? Yes, anyone should be able to sue, however frivolous. However, it is up to the legal system to ensure that frivolous claims fail.
Will they win? Who knows. Data is freely available about fatty foods and their impact. If the kids should sue anyone it is the negligence of their parents. However, this seems no more frivolous than the suing of the tabacco companies to me, and that was successful.
As for poor ol' maccy D's and being sued, the first one I haven't heard of. The second one, however isn't as frivolous as it first sounds. There was a post a while back from Diandra with the full details. I'll see if I can find the thread...

The amount of people suing in America for things that over here we just take as us being silly does scare me. I was thinking a while back that is seemed to be a worrying trend that the suing over in the US has started to travel our way.
Have you listened to the Radio recently or watched TV? How many of those Personal Injury Companies have you seen advertising.... Had an accident in the last 3 years that wasn't your fault? Contact us & we will get you loads of money by suing the person who responsible! Well OK they don't say *all* of that but that is what they do.
I just think it is very sad that people take things to extremes in the hopes of being handed loads of money so they can then loaf around all day, sit on their bums then probably sue the makers of the sofa as there was no warning to say that they would get square bums if they sat on their sofa all day!

In america there are so many lawyers that they have to justify their existence somehow and so there are SO many stupid law suits.
In the UK, since legal aid was withdrawn (i believe), the amount of 'claim' firms advertising has grown exponentionally and so the amount of stupid claims here will probably increase so that they can justify their existance.
It's just the stupid leading the stupid.

Oh, how I will despair when companies like KP remove the warnings from their packets of peanuts that state: "Warning: This Product Contains Nuts."
